This case involves showing a defendant must make to obtain a summary judgment in Texas courts in a defamation action brought by a public official or public figure. The court of appeals reversed the trial courts summary judgment in favor of defendant and remanded for a trial on the merits, holding that defendant had failed to establish an absence of actual malice as a matter of law. 742 S.W.2d 726. While the decision below correctly applied existing Texas case law, we overrule two prior decisions of this court to hold that, as to some of the allegedly defamatory statements in issue, defendant did negate actual malice as a matter of law. We affirm the judgment of the court of appeals in part and reverse in part, remanding a portion of this cause to the trial court for further proceedings.
